FELONY FISH – TERMS OF SERVICE

OVERVIEW

This website is operated by Felony Fish. Throughout the site, the terms “we,” “us,” and “our” refer to Felony Fish. Felony Fish offers this website, including all information, tools, products, and services available through this site, conditioned upon your acceptance of these Terms of Service (“Terms”).

By visiting our website, purchasing a product, submitting artwork, requesting customization, approving a proof, or otherwise using our services, you agree to be bound by these Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced on our website.

Please read these Terms carefully before using our website or placing an order.


SECTION 1 – ELIGIBILITY AND USE OF WEBSITE

By using this website or purchasing from Felony Fish, you represent that you are legally capable of entering into a binding agreement or are using the website with the permission of a parent or legal guardian.

You may not use our products or services for any unlawful purpose or use the website in violation of applicable local, state, or federal law.

We reserve the right to refuse service, cancel an order, limit quantities, or restrict access to our website when reasonably necessary, subject to applicable law.


SECTION 2 – PRODUCTS

Felony Fish sells products that may include challenge coins, patches, stickers, apparel, engraved products, personalized products, 3D-printed products, accessories, promotional products, and other custom or ready-made merchandise.

We make reasonable efforts to accurately display our products. However, colors, finishes, textures, engraving appearance, materials, dimensions, and other characteristics may vary slightly from photographs, digital renderings, prototypes, proofs, or samples.

Product photographs and digital mockups are illustrative representations and may not perfectly reproduce the appearance of a finished physical product.

Minor manufacturing variations that do not materially affect the intended use or overall design of a product are not considered defects.


SECTION 3 – CUSTOM AND PERSONALIZED PRODUCTS

Many Felony Fish products are made, engraved, printed, manufactured, or otherwise customized specifically for the customer.

Customers are responsible for reviewing all personalization information submitted with an order, including names, spelling, dates, numbers, artwork, colors, logos, dimensions, and other requested details.

Felony Fish is not responsible for errors contained in information or artwork supplied or approved by the customer.

Once production has begun, custom or personalized orders generally cannot be changed or canceled.

Custom and personalized products generally cannot be returned or exchanged unless the product arrives damaged, defective, or materially different from the approved design or order specifications, subject to our Refund Policy and applicable law.


SECTION 4 – ARTWORK AND CUSTOMER-SUPPLIED CONTENT

When you submit a logo, photograph, illustration, badge, insignia, trademark, phrase, design, or other material (“Customer Artwork”) to Felony Fish, you represent and warrant that you own the material or have sufficient permission, authorization, license, or other legal right to use the material and authorize Felony Fish to reproduce it for your order.

You grant Felony Fish a limited, non-exclusive license to reproduce, modify, resize, convert, engrave, print, manufacture, or otherwise use Customer Artwork solely as reasonably necessary to prepare proofs, manufacture your products, fulfill your order, and provide related customer service.

Unless separately authorized by you, submitting Customer Artwork does not transfer ownership of that artwork to Felony Fish.

You are responsible for obtaining any permissions required for Customer Artwork you provide.

Felony Fish reserves the right to decline a project when we reasonably believe the requested material may violate applicable law or third-party rights.

To the extent permitted by law, the customer agrees to be responsible for third-party claims arising from Customer Artwork supplied by the customer when the claim results from the customer's lack of authorization to use that material.


SECTION 5 – DESIGN SERVICES AND PROOFS

For certain custom products, Felony Fish may provide digital proofs, mockups, renderings, or design concepts before production.

Customers are responsible for carefully reviewing proofs before approval.

Approval of a proof constitutes authorization to manufacture the product substantially according to the approved design.

Customers should review spelling, dates, numbers, placement, orientation, logos, artwork, and other customization before approving a proof.

If Felony Fish manufactures a product incorrectly compared with the final approved proof, we will work with the customer to provide an appropriate remedy consistent with our Refund Policy and applicable law.

Digital proofs are representations of the intended product. Differences may occur between a screen rendering and a physical product due to manufacturing processes, materials, plating, enamel, engraving, printing, lighting, monitor settings, and other factors.


SECTION 6 – CUSTOM DESIGN WORK

Artwork, layouts, illustrations, mockups, modifications, and other original creative work produced by Felony Fish remain the intellectual property of Felony Fish unless ownership rights are expressly transferred to the customer in writing.

Payment for a physical product does not automatically constitute purchase or transfer of the underlying design files, editable artwork, source files, vectors, manufacturing files, or other intellectual property created by Felony Fish.

Customer-owned trademarks and Customer Artwork remain the property of their respective owners.


SECTION 7 – ORDERS

Submission of an order constitutes an offer to purchase the selected products.

We reserve the right to accept or decline orders, subject to applicable law. An order may be canceled or refunded if, for example, a product becomes unavailable, an obvious pricing error occurs, necessary customization information cannot be obtained, or we determine that we cannot reasonably complete the requested product.

Felony Fish may contact you using the email address, telephone number, or other contact information supplied with your order when clarification or approval is required.

Delays in responding to requests for artwork, proofs, approvals, shipping information, or other necessary information may delay production.


SECTION 8 – PRICING AND PAYMENT

Prices may change without notice.

The price applicable to an order will generally be the price shown when the order is submitted, except in cases of obvious pricing, typographical, technical, or system errors.

Applicable taxes, shipping charges, rush charges, customization charges, design fees, or other charges will be disclosed when applicable.

Payment must be successfully processed before an order enters production unless Felony Fish expressly agrees otherwise.


SECTION 9 – PRODUCTION TIMES AND RUSH ORDERS

Production and completion dates are estimates unless Felony Fish expressly guarantees a particular date in writing.

Custom manufacturing may be affected by material availability, equipment issues, artwork approval delays, manufacturing partners, shipping carriers, order volume, or circumstances outside our reasonable control.

Payment of a rush fee means Felony Fish will make commercially reasonable efforts to prioritize the order according to the agreed schedule. Unless expressly stated in writing, a rush fee does not guarantee carrier delivery times or circumstances outside Felony Fish's control.


SECTION 10 – SHIPPING AND DELIVERY

Shipping and delivery dates are estimates unless expressly guaranteed.

Felony Fish is not responsible for carrier delays or other shipping events outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

If a package is returned because of an incorrect or incomplete address supplied by the customer, additional shipping charges may apply before the package is resent.

Claims involving lost, damaged, or missing shipments should be reported to Felony Fish promptly so we can assist with the carrier or determine an appropriate resolution.

Nothing in this section limits rights or remedies that cannot legally be waived.


SECTION 11 – RETURNS, REFUNDS AND CANCELLATIONS

Returns, exchanges, refunds, and cancellations are governed by our Refund Policy, which is incorporated into these Terms by reference.

Because custom and personalized products are manufactured specifically for the customer, they generally cannot be returned solely because the customer changed their mind.

This restriction does not eliminate any rights a consumer may have regarding defective, damaged, incorrectly manufactured, or otherwise nonconforming products under applicable law.


SECTION 12 – 3D-PRINTED PRODUCTS

Certain Felony Fish products are manufactured using additive manufacturing or 3D printing.

3D-printed products may contain visible layer lines, seams, minor surface variations, support marks, or other characteristics inherent to the manufacturing process. These characteristics alone are not necessarily defects.

Unless expressly advertised otherwise, 3D-printed products are not intended for high-temperature environments, structural applications, safety-critical applications, or uses beyond their advertised purpose.

Customers should follow any product-specific care instructions provided with the product.

Products should not be exposed to temperatures or conditions beyond those reasonably suitable for the material from which they are manufactured.


SECTION 13 – PRODUCT USE AND SAFETY

Customers are responsible for using products according to their intended purpose and any supplied instructions.

Felony Fish is not responsible for damage caused by misuse, unauthorized modification, improper installation, neglect, abnormal environmental conditions, or use inconsistent with supplied instructions, to the extent permitted by applicable law.

Products intended primarily as collectibles, novelty items, display items, promotional products, or decorative products should not be relied upon as safety equipment unless expressly identified as such.


SECTION 14 – LIMITED WARRANTIES

Certain products may include a product-specific limited warranty or replacement policy. Any such warranty will be described on the product page, packaging, care instructions, or accompanying documentation.

Product-specific warranties supplement these Terms.

Nothing in these Terms excludes, restricts, or modifies any warranty, guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under applicable law.


SECTION 15 – INTELLECTUAL PROPERTY

Except for Customer Artwork and third-party materials, the content of the Felony Fish website—including original graphics, photographs, product photographs, text, branding, layouts, designs, and original artwork—is owned by or licensed to Felony Fish and is protected by applicable intellectual-property laws.

No Felony Fish content may be copied, reproduced, distributed, sold, modified, or commercially exploited without permission except as otherwise permitted by law.

Third-party names, logos, trademarks, insignia, artwork, characters, and other intellectual property appearing on products or Customer Artwork remain the property of their respective owners.


SECTION 16 – NO GOVERNMENT OR AGENCY AFFILIATION

Unless expressly stated otherwise, Felony Fish is an independent business and is not affiliated with, sponsored by, endorsed by, or acting on behalf of any governmental agency, law-enforcement agency, military organization, public entity, or other third-party organization merely because a product references, depicts, or is inspired by such an organization.

Any third-party names, marks, insignia, or references remain the property of their respective owners.


SECTION 17 – ERRORS AND INACCURACIES

Occasionally information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, or other information.

We reserve the right to correct errors, update information, or cancel an affected order when reasonably necessary, subject to applicable law.

If an order is canceled after payment because of an error attributable to Felony Fish, the applicable payment will be refunded.


SECTION 18 – THIRD-PARTY SERVICES

Our website may contain links to or integrations with services operated by third parties.

Felony Fish does not control and is not responsible for independent third-party websites, services, payment providers, shipping carriers, or other third-party services, except to the extent responsibility cannot lawfully be excluded.


SECTION 19 – SHOPIFY

Felony Fish's online store is powered by Shopify. Shopify provides the ecommerce platform that enables us to offer products and services online.

Purchases from this store are transactions between the customer and Felony Fish, rather than purchases from Shopify.

Certain information may be processed by Shopify as described in our Privacy Policy and Shopify's applicable privacy terms.


SECTION 20 – PRIVACY

Personal information collected through our website is handled according to our Privacy Policy.

By using the website, you acknowledge that information necessary to process transactions may be provided to service providers such as our ecommerce platform, payment processors, shipping providers, and other providers reasonably necessary to fulfill orders.


SECTION 21 – PROHIBITED USES

You may not use the website to engage in unlawful activity, interfere with the security or operation of the website, introduce malicious software, attempt unauthorized access, scrape or harvest information in violation of applicable law, impersonate another person, or infringe the intellectual-property rights of Felony Fish or another party.


SECTION 22 – DISCLAIMER AND LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Felony Fish will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or products.

Felony Fish does not exclude or limit liability where doing so would be prohibited by applicable law.

Nothing in these Terms is intended to waive statutory consumer protections or other rights that cannot legally be waived.


SECTION 23 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Felony Fish harmless from third-party claims, damages, or reasonable costs resulting from your unlawful use of our services, your violation of these Terms, or Customer Artwork you supplied without sufficient authorization.

This section does not require a consumer to indemnify Felony Fish for Felony Fish's own unlawful conduct or liability that cannot legally be transferred to the customer.


SECTION 24 – SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or severed as necessary, and the remaining provisions will continue in effect.


SECTION 25 – GOVERNING LAW

These Terms and transactions with Felony Fish are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another applicable law requires otherwise.

Nothing in this section deprives a consumer of protections or rights that cannot lawfully be waived.


SECTION 26 – CHANGES TO THESE TERMS

We may update these Terms periodically.

The current version will be posted on our website with an updated revision date. Material changes will be handled in accordance with applicable law.

Your continued use of our website after changes become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.


SECTION 27 – ENTIRE AGREEMENT

These Terms, together with our Refund Policy, Privacy Policy, Shipping Policy, product-specific terms, warranty information, and other policies incorporated by reference, constitute the agreement governing use of our website and purchases from Felony Fish.
